Question About Divorce

My husband filed divorce papers today and we have a court date for the end of November. I signed the papers but truly do not want the divorce -- I still feel it could be worked out.

My question is has anyone ever had the judge decide not to grant the divorce? Thanks.

I am sorry that you are going through this as divorce is never easy for anyone. As much as I admire your desire to want to make your marriage work, unless both parties are ready and willing to do what is needed to fix things then it's really not going to happen.

I'm so sorry for you A.,this is hard I know. I truly do know. ANYTHING can be worked out IF BOTH OF YOU WANT to work it out. When you have a spouse, everything includes both of you. If one drops out then what can you do other than what I'm sure you have already tried to do.
Once it is started I doubt very seriously that the judge would even consider it. You need to accept this and watch out for your own interests by getting a lawyer and counter filing.
You don't give any details how long you were married and what brought you both to this point, but you do need to protect your interests and do it now or plan on being steam rolled.

Somewhat over 30 years ago now, I was divorced when I did not want to be divorced, too. My biggest regret in my life is that I did not fight harder for him. I just signed the papers and went along with it, hoping we would remarry one day. He remarried within a month and that was that. He is miserable with her, but remains married to her even now, and he regrets not having stuck with me, too. But it's too late now. My advice would be that you show up in court and tell the judge that you do not want this divorce, that you want to work things out. He will ask you why you signed the papers and you can answer that honestly. Just be honest and open and frank with the judge. He may or may not grant the divorce then. He may order you both to counseling for a period of time instead of immediately granting the divorce. Meanwhile, let your husband know that you want to work things out, that you do not really want this divorce. Does he know this yet? I assume he does know, but wants this divorce anyway. Is there another woman in the picture? if so, fight for him! Let him know you are not ready for this divorce.

Hi,

Do you have a lawyer -- do you know who your judge will be -- which state are you in -- do you have kids?

Are you sure that you are going for final hearing at the end of Nov.? Two years ago when my ex-husband walked out about this time of year -- we had a hearing at the end of Nov. but it wasn't the final hearing -- it was just to start the process of who was going to pay what -- what grounds the divorce was being filed under -- custody of the kids and things like that.

Unless you decide to not contest anything -- divorces just don't happen over night -- even though my ex is the one who walked out, I filed for the divorce & he didn't want me to contest anything so his divorce would be cheaper -- he ended up ringing up a lawyer bill close to $10,000 for me because he fought everything & it took me 18 months to get my divorce to be final & that is only because the judge got tired of my ex's issue and made my ex's lawyer sign the final papers since he was working out of country.

Is it possible to get your husband to go see the movie "Fireproof" with you before your court date? It could change the way he feels about the possibility of working it out. Then maybe you could postpone the court date for a couple of months until you try the Love Dare. It's worth a shot! Tell him it wouldn't be fair to you or him or the rest of your family to not at least try. Neither of you would want to spend the rest of your lives wondering if you could have done something more.
I pray that you will find peace with this, however it works out for you.

A., please don't sign anything until you at least speak with an attorney of your own or a counselor. Do you have a pastor or someone you truly trust? If you can't afford legal counsel, call legal aid to protect your rights. Please seek help before it is to late. Seek God's will first! Something doesn't sound right here, so please protect YOU!
