Daughters Dad Is Getting Married and Seeking Custody!

i have 2 little girls from different dads; my older daughters dad is in her life, however, my younger daughters dad left us as soon as i found out i was pregnant, and has only seen her twice. he lives in connecticut, while my children and i are in va. he recently proposed to his girlfriend, and once they get married, he told me that if i didnt terminate his rights he would seek custody. MY GREATEST FEAR IN LIFE IS LOSING MY CHILDREN! they are everything to me. everything i do is for them. i have sacrificed evertything for them and wouldnt have it any other way. i dont trust him to watch her for an hour, let alone take her from me! its important to me she knows who her father is, but i cant bear being without either of my girls. does anyone know what rights he has? what rights i have? i think im only scared b/c he will be married and have that 'family' structure... otherwise, his case holds no water. let me know if anyone has been through this or knows anything! So What Happened?

WELL, for now, his fiance left him (cant help but smirk at that)... and he knows hes nowhere near financially stable to take my baby without her, so the issue stands as is. thanks for everyones input! ~R.

I agree with the previous post. The only reason he is pulling this one is to get out of paying child support. I am sure he resents having to send money every month (WHICH HE SHOULD!). And that is most likely the only motivation behind this empty threat. No court in VA would take custody from you.

Hi! I really can't say "I see what you going through" because i never been through it, but my aunt did.and from my understanding the dad will have to prove that you are a unfit mother. and yes she had to do alot of things that were order by the courts but she did get full custody of her child.

I'm so sorry you're going through this...

First Step: Just put the fear of him taking her out of your mind and DO NOT be scared by his empty threat. He's pulling a (weak) scare tatic on you. What he's 'demanding' is completely hyrocritical. If everything is as you say it is, IMO, no court in their right mind would give him complete custody out of the blue and take her away from you. They're not going to take a child out of their loving, functioning home just because the child is being reaised by a single mother and allow her to be shifted across statelines into a home with two strangers who she's never had real contact with just of because of his shared DNA with her and he's getting married and that's going to be a real 'Mom & Dad' unit - not even in conservative ol' Virginia.

Second Step: Go see your attorney (or find one) and get your bases covered legally - they're not only going to give you better advice than any of us on here could give you, but they're going to give you the legal guidance to actually deal with this creap. Stand up to him with your counsel and say, "Try Me". Please don't take offense, but he sounds like a pathetic loser and knows how to push your buttons. Do Not let him.

R., I understand I have a great 5 year old. Her father has seen her about 5 times in her life and lives in PA. He does occ. call and request to see her and when I refuse he threatens to take her away. It too is my biggest fear being a single mom. If you are doing a great job, there is no way he can take her away. Perhaps a shared situation will give you time for you. I wish you all the best.
