My 14 soon to be 15 year old niece is coming to live with my husband and I in Germany on a permant basis. My question is what form of guardianship do we need for her? My husband is Active duty Air Force, and my niece is currently a ID card holder through the Army because she lives with my parents right now and my dad is retired Army, my mom does not understand why I want her to obtain an ID through my husband since she already has an ID card and I tried to explain it to her but (?), she is more than willing to give a power of attoney though. Any help would be greatly appreciated.

We went to jag here in the states and they said to obtain some type of custody, so we are currently hiring an attorney and to get joint managing conservatorship with my parents, hopefully everything goes smoothly and she will be joining us by the end of the summer. I would have thought that more moms would be in a similar situation as I am, but was suprised no one responded with a similar situation, seems like in the states a lot of people have nieces and nephews and such living with them, but then I realize that they are not legally reponsible for them which I realize is very dangerous! My husband is a personnel officer for the Air Force and he says that custody is a key component for command sponsorship. Contact the base legal office right away. Her enrollment in school and her medical care could be jeopardized because she's not command sponsored. Good luck.
You should check with the legal office to find out exactly what you need, but i would think a residential custody aggreement would be enough.But again, definatly check with legal.

Go straight to the base legal office on Ramstein. They have legal assistance times throughout the week. You need legal advice, not just the opinions of mothers.
Lyn, I'm not certain about the laws in Germany, however, a Power of Attorney will not go far with your niece living with you permanently. I used to work for the Department of Juvenile Justice before moving to Yokota, Japan, and the law required that you obtain custody for the minor child to reside with you. It would be in your best interest to obtain custody if she's going to be with you on a permanent basis. The custody papers will allow you to register her in school, obtain medical records, and take care of any needs that may occur while she's with you without having to consult with your parents regarding her well being. She will legally be your daughter. Once again, I'm not certain about the laws in Germany so you may want to consult with someone in the legal field. Good luck and God Bless.
