Ex Owes Money in Back Child Support & Trying to Claim

Hi I was wondering if there was anything that i can do legally because ex owes money in back child support and has not seen our child in over a yr but he claimed him on his income tax return

What can I do next?

I contacated the Irs they took down the info and they will get back to me as soon as the look into it.

You need to go and make a petition through the court. He will need to come to court, if he doesnt then a warrent will be issued for his arrest. If you have previously went through court for the support (some people just have an agreement but not a legal pettition) then it should be no problem getting it. They will probably increase the support if you go back to court. if I were you i woiuld file a petition with the court for back support right away. You can challenge the tax return by showing proof that the child resided with you. you need to get a statement from your pediatrition showing that he resides with you. If you submit this to the irs, you will be granted the child deduction and your ex will be paying a fine. e mail me if you have any questions. We went through something similar. My step son lived with us, but his mother claimed him. My sister is also a lawyer and guided us through everything

That's an easy one, report him to the IRS, he'll get penalized for falsifying his return and you'll get your money.

If so call NY state child support

They will put lein on his paychecks

He shouldnt claim him

well i was having the same issue...lol
if you work you should claim her even though he already did and when the IRS finds out they will send both of you letters and you will tell them that he does not support the child and he would have to give the money back to IRS now as far as child support goes go to your nearest child support office or go to this website www.supportkids.com.

you must fill out an irs form to allow the non-costodial parent permission to claim the child on their taxes it opts for 1 year or two if you did not have to claim taxes and are in good standing with ex i say allow him but if no contact and no assist and he just claimed you are 100% entitled to claim your child without question. been there done that beyond beliefe if you need to dish on child suppot issues feel free to email me at ____@____.com question is acceptible.

He can't do that. You should contact the IRS or continue to claim your child, so the IRS can audit his butt! As long as you have proof, you are straight.

Report it to the IRS and there is a way that you can block anyone from using your child's social security for their taxes in the furture. Just ask IRS about it.

I did that for my daughter when her father was trying to do the same thing. Now only I can use her number unless I give authorization for someone else, like my mother.

Mainly report hte incident to IRS and he will be penalized for it, big time. Also report it to the agency thta handles your child support case and they will handle it from there. It will or may be time consuming but do it anyway.

Girl, if you also file taxes, you need to make a report as it is illegal for two people to claim a child at the same time and more important, the parent who is allowed to claim the child is the one with whom the child has lived for the last 12 months!!! (Even if he was giving support)
You will need to call family court (if you already have an open case) and inform them that you are sure he is working however, if he is working off the books, it is useless. Make sure they run his social security number and they will know if he is working on the books.
If you don't already have an open case.... Go to family court and with his address and social security number and address to where he works if you know it and they will go to work... It may take time, but the system does work
