Upset with Photographer - Do I Have the Right to Be?

Prior to my baby being born in October, my husband and I registered at the local Babies R Us. Part of the package was that you got a free session with a local photographer and it also included a collage (a pic of newborn, 3 months, 6 months, 9 months and 1 year old) - all on one picture. The deal was that you go to these sessions and at the end of the year, you would get the collage. Well...this photographer is not cheap (very expensive in fact) and my husband and I wanted to wait until the end of the year to pick the picture(s) that we wanted to buy (not part of the collage deal). I guess the photographer got upset after the six month session because we weren't buying along the way and stated that if we waited for more than two weeks after the session the price of the pictures would increase by 10%. I can see what they are doing. They want us to buy pictures every single time we go. First off...we simply couldn't afford to do that. Second, I don't think it's fair for a business to increase the cost (mid-way through the deal at least). I could see them giving me a discount if I bought some pictures every single time.... I also would think it would be easier (not harder) for the photographer to wait til the end of the year because they would be doing the collage picture - that way they could do it all at once.

I hope that I have explained this situation well and I just want to know if this seems fair to everyone? I was just taken back when the photographer said that. I mean, if I would have known this when my baby was born, I would have gone to someone else. My baby is now almost 9 months old and I can't turn back time.

So What Happened?

Well, what ended up occuring was that I finally received the collage of my daughter from birth to one year. Then I decided that I would order a second collage for my husband for Christmas. It was expensive, but it did turn out nice. I certainly will not be going to that photographer again though. Much too pricey for the hassles.

I probably would be upset also. First thing I would suggest is checking the contract (if you have any) or any other documentation that you were given. Sometimes it states "prices subject to change without any notice" at which point you don't have a choice but to accept the increase in price. You also want to check to see if it states anywhere any wording on price increase due to not buying or any language like that. If you do not have any of that information OR did not receive anything then I would go in and discuss this with the person that told you the price would increase. Ask for the documentation that states it is a 10% increase and why it was not given to you prior to the start of the pictures? If there is no choice at all I would buy the cheapest package if you can and then contact the main office and file a complaint. Good luck! S.

Make sure you explain to him what you were told the deal was and at no point were you told that you need to buy photos during a set time frame and that you wanted to wait until the end of the year to pick all the photos you want. Also, get a price list of what he charges. If there is nothing about a 10% increase on photo purchased 2 weeks after you see the proofs or a 10% discount if you buy in the 2 weeks I really think he is trying to presure you into buying now. If he is still holding to the 10% increase then at the end of the year after all the photos are taken, pick out all the photos you really want, get the price and if there is 10% added to every photo start taking photos off you must have list and tell him why. You will see how fast his store may change.
Contact you local BBB to find out what you can do about this and if he is a member file a claim. I would wait until he has taken all the babies photos first.

I would definitely be angry. I think I might also call Babies r Us and mention it to them too. Let them know who they are sending their new mothers too, like we don't have enough to be stressed about! Good luck!
By the way, I know the picture people in the mall have really great props and scenery, but they are pricey too. My sister has a 3 year old girl, and she took her there the first year, but after that, she's been going to wal-mart for pics and they're just as cute, but sometimes half of the price. (she just suggests going to a newer walmart.
I went to Target in December and they were pretty nice too.

I would get your contract, read it, and then file a complaint with the manager of your store and keep complaing the whole way up the corporate ladder.

Sorry you went through this. That's corporate business for you. I own my own photography business and would NEVER increase prices in the middle of dealing with them. My clients have up to 3 weeks from the time their online gallery is made available! I also creat collages. My free gift this year is an 8x8 collage from their session - photographer favs though. I'm working on collages to offer. still getting them together. Oh and if my client places an order within the first week of their gallery being available, they receive a 10% discount on their total order. www.JESPhotographyOnline.com

That is terrible! We go to JcPenney's who has Lifetouch in their store for photos and they are wonderful. All of my friends use the Penney's in their area too, you should check them out for later photos. That being said you should also tell the photographer that you will do whatever you can to make sure that babies r us knows what he is doing - that deal probably generates him A LOT of business, it would not be in his best interest to lose it or to have it tarnished. We also have a news station in the area that you can call and tell them your situation and they'll do like an expose on the business. I can't remember which station (I hate to watch the news, its too depressing!) but I remember my hubby talking about it. You should check out your local press and see if they do anything like that, then you'd have something to threaten him with if he gets nasty or worse destroys your pics because you didn't buy them.
