Can a credit card company take you to court eventhough you're paying them something (100) monthly???

if you are having problems i recommend calling American Consumer Credit Counceling, ACCC. I've worked with them and will make my last payment this summer! It took 5 years instead of 15 to pay off, and they only charge a small fee, 2 or 4 dollars/account. They are very nice and helpful and will stop all of the harassment. Good luck

Yes, a credit card company can take you to court even if you are paying them. If the amount that you are curretnly paying them ($100) is less than the amount on your monthly invoice (contract amount) then they can sue you for violation of the contract terms. However, when you get to court and show that you have been making an effort to pay the end result will most likely be both you and the credit card company agreeing to monthly payments that you can afford.

I am pretty sure they can try, but if you have proof that you are attempting to pay SOMETHING then they won't be able to do much.
