Question About Rights of Other Parent

Go to one of the following and ask them for help: Some charge money and some do not - perhaps you can go through the Attorney General to ask these same questions as well. I was not able to afford an attorney and made $120 over the limit for pro-bono work from Legal Aid. I just decided to start calling the TOAG directly and got info from them as much as possible.

I'm not a lawyer but if he does not let you have your kids on your visiting days just because you are 30 minutes late, HE is the one in violation, not you. I think any reasonable judge would see it that way, but then not all judges are reasonable. You said you have tried Houston Volunteer Lawyers, you should be able to at least get a one time consult from them on how to deal w/ this problem. If it were me, he would be the one worrying about "forfeiting" his rights if he denied me my visitation based on something so ridiculous. If you have a court order giving you visitation and he refuses to let you pick them up for something so stupid, call the police!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! They may or may not help you, but I'd be calling just the same.

Generally there is a statement in the decree that states these are guidelines if the parents can not agree. 6pm is standard but as Kim G stated, no reasonable judge would see a problem with being 30 mins late because of traffic. He is also going against a court order that states you have visitation rights so he can NOT keep your children from you because of something you can't control (work hours and traffic). I can not assume you've already discussed that with him, but I would definitely let him know that he is going against a court order for you to visit with your children. I would seek professional advice, get a consult at the least so you know your rights on this specific issue. He is not looking out for the benefit of the children; it's a control issue for him. On the TOAG website, there is a link for a PDF file on Non-Custodial Parent rights. I would review that. It may have something useful in there to help you.

if you have a court orde, you can call the Att Gen office and have another mediation to rearrange your visitations if it is impossible to meet....they are willing to compromise because they want what is best for the children

C., I have no advice to give and for that I am sorry. But, My heart is with you and I have already prayed for your healing and for some compassion from your ex becasue he needs it. Keep fighting even when it seems like you are losing.
