I Am in a Bind and Need Some help..please!

I am going to try and make a long story short. Last May I had maternity photos taken with myself (9months pregnant) and my 3 children. I paid by check for 45 photos on CD plus 10 prints and she sent me a link of my photos with her business name watermarked on them. Well it took me a while to get back to her as my child was born with a birth defect that had us back and forth to Raleigh for a few months. I did contact her and let her know I would get back to her.

When I was finally able to get back to her the deal changed. She told me 45 photos on cd included the 10 prints. I asked if she could check her records to be sure. I never heard from her again. She did manage to cash my check though. I have tried on many occasions to contact her.

Here is where the problem lies. I have tried to look into small claims court. You have to be present to do that and we are currently preparing to be stationed overseas. So I can not afford to make it here whenever there may be a court date. I also contacted a lawyer who told me it would cost me 600.00 and they would make an effort to find her but if she did not show there wouldn't be much else they could do and I would be out the money.

I just need to know where I can go from here. Considering I have paid her for the pictures, then how do I get her watermarks off of them. It is not like I can take these photos over again, that was my last child. Any help or advice would really really be appreciated. Thank you for hearing my situation!!

As a professional photographer I am sorry this happened to you. She should have worked better with you. It was 10 prints, her cost is not that high! As far as photoshop to try to get her water mark off, it is illegal and she could actually sue YOU. By putting her watermark on them, she copyrighted them. I know this is a mean answer, but it is the truth.
If I were you, I would keep calling her until she finally wanted to get you off her back and gave you the prints you paid for.

You might just have to "eat" this one, it's probably not worth the stress it's putting on your family. At the very least call the Better Business Bureau and report her...also, word of mouth could make sure this dosen't happen to someone else.

depending on how much you paid for the pictures it would probably be a waste of time to take her to court. if the watermark is all over the picture youcant get it off. if it is at the top or bottom you could save the pics to your computer and then crop them. but iwould spread the word not to use her to people.

I'd think you could Photoshop the watermarks out. Check with a computer geek. I'm sorry you got ripped off.

Definately report her to the Better Business Bureau...but you can also hire a lawyer for about 100.00 to send a letter to her threatening to take her to court. Sometimes a threat can do the job. I have done this recently for an issue that I had with a contractor. Can be really effective.

Leave her a message, that you are going to the local news paper, and using her name, so no one else goes through what you have. Make sure you give a time limit. She will call you quick, it is not slander if you tell the truth. People do not like to have anything in the media that embarrasses them. T., I am so sorry it happened to you.:(
I do not have any advice. We got scammed on Craigslist for $3600 2 years ago. Had all the emils with the guy and phone calls. Cops came and look at the data on the computer. Said nothing could be done.The crazy thing they told my hubby in the small claims court that if he would file, but the person did not show up......he would still get the $$$$ when the guy died. Now, I am not making any suggestions or anything(even though we probably wanted to hurt the guy then since we almost lost the house, cars, had no food ,our perfect credit got ruined, could not fly overseas to see my mom who was just diognosed with breast cancer at that time)As Christains we had to let it go. What goes around, comes around.
I surely hope it works out for you....can you not go back and just take the prints on the CD ?? At least you will have something.

Firstly, file a complaint against her business with the Better Business Bureau. Also, look into filing a complaint with the Attorney General's office. Both offices need to know of her actions here to protect further consumers. I am not sure what else you can do with this from a legal standpoint. Just make sure you tell everyone you know about her shady business practices. I am sure that other marine families will want to steer clear.
Finally, find a photoshop guru and see if you can get that watermark off. It should be doable. Good luck!
