Im just curious about this one, as on my last question is about a custody case, well Im in oklahoma and I will have court in atlanta geogia, my question is : can I use my economic status for not showing to that court??
right now we are not able to afford any travel expenses ,even on christmas we manage to limited our kid gifts to less than $100 , Im sahm so I don't have an income .... can I filed something like this in court?
thank youin advance to all moms and legal force....for your time.
Also Im 6 mo pregnant and have high pressure and gestational diabetes and Im going to ask my obst for an affidavit to not travel while Im pregant....but my main thing is the money....

The only people who can reliably answer this question is the court in Atlanta or an attorney who practices in Atlanta and is also familiar with your case. I urge you to call the court directly and talk with them.

If you're wanting custody, I suggest that you call the court immediately. You not showing up will cause the other person to win by default. If the court can't accommodate you, perhaps by having you present via telephone or computer, then I suggest that you may be able to hire an attorney to appear in court for you. I believe that you'll need to find some way to have representation in court.

If you cannot make it to court, you need to contact the court and let them know. Don't just miss.

See if there is a free legal clinic in your area that you can contact. You have alot listed here that could excuse you. Call the court in atlanta and talk to them about it.

Call the court or a legal office in that area and see if you can give someone you know and trust a Power of Attorney to show up and act on your behalf. Send a notarized statement of your situtation and position in this case if possible to the judge's office. I don't know if any of these things will work, but I guess that's where I would start.

My friend's ex sued for custody in CA she was living in OH. She moved because money was tight and with that reason, she was not excused. In fact she was always held responsible for the expense of bringing her child back to CA for visitation. If you don't have representation on the day of court, the court will assume you don't care enough to be there and likely things will go in favor of the parent who is there. Mostly, because you won't be present to have your side heard. Good luck.

Call the court in Atlanta and ask what form your doc needs to fill out for you to be able to miss court on a medical reason. They may need to fax the form directly to the docs office and get the form back from the same number to verify it is actually from a doc.

If you can't travel they can surely send someone to pick you up after a bench warrant is issued so take care of calling them tomorrow or Tuesday.
