Working from Home and Hiring Employees

I started my own service business and started working from home in January. Since this is my own business I am being 1099'd by the companies that I provide my services to. I have since been contacted by other companies who are interested in utilizing my services, which will require me to need to hire helpers. This means my business is growing and I am ok with that. With hiring helpers, I want to also 1099 them. The problem is I don’t know what I need to do in order to 1099 the people that I hire and was hoping that someone here might be familiar with that process. Thank you.

Hi H.,
I'm new to the Mamasource community and saw your post. Not sure if have done anything yet but here is what I would suggest.

The best course of action would be to seek a lawyer. Commonly a person who "hires helpers" is considered an employer and in the state of Nevada should be incorporated, licensed and have an EIN number and the appropriate insurance. I would suggest you definitely talk to the lawyer about your specific situation but for actual incorporation services you can save a lot of money by doing it yourself by utilizing many different services available online.

Hi H.! Congratulations on your growing business!! When you hire someone to help you, have them complete Form W-9 (you can obtain from the irs.gov website). This will give you their address and tax id which you will need to have in order to prepare 1099s at year end. Please message me if you need assistance with preparing your 1099s - I have a home based bookkeeping service and can help you out with recording keeping and other tax issues!

Basically when you do this you are in a sense subcontracting work. So long as the individual is aware that they are solely responsible for their taxes. They need not be professionals and as long as you maintain records to verify this information. If you pay cash, have them sign a receipt, pay by check to keep a paper trail, etc. GOOD LUCK ON YOUR BUSINESS.
