Need Advice - Scarborough,ME

My 2 kids have been going to my boyfriends mom(i've known him since grade school) for daycare 3 or 4 days a week. About a month ago he went to pick up the kids from his moms and at the same time another childs mom was there. While all the adults are inside the kids are outside unsupervised and my 3 year old decided to use a rock to draw on the other moms car. Its an almost $700 repair that i cant even begin to afford. Fortunately the other mom is a close friend of his families and i'm sure she'll let us pay over time. My dilema is i'm extremely frustrated...on the one hand i dont feel like i should be expected to pay as i wasnt even there, and i dont feel a 3 and not quite 5 year old should be outside alone in the first place(its not a fenced in yard or anything). On the other hand i dont want to cause problems. I've been racking my brain for a solution and quite frankly trying to figure out how to pay for childcare at a daycare so my kids are getting the interaction they deserve while i'm at work.

First Off I AGREE with you totally. NO child should have been outside unsupervised...it never would have happened. Second that is what insurance is for...either the car owners or the day car providers. I personally would not pay it...or at least not all of it. Like I said it wouldn't have happened if he was unattended in the first place...and when you put your child in day care (especially with a relative) you expect them to be cared for properly. Good luck adn let us know what happens in the long run.

Don't they have car insurance??? Most policies are under $500. and this should be covered it happened at a licensed daycare you should talk to her she has insurance for things like this I would not pay the bill accidents are accidents If she is still making you pay for damage take car to a local tech school like Assabet Valley in Marlboro the kids work on cars and learn a trade is inexpensive too. First and foremost, I most definitely would NOT be comfortable if I knew my 3 year old was outside unsupervised with another child - especially in the world we live in today! That in itself is asking for trouble.

That aside, when your kids are with a daycare provider (private or public), it is the responsibility of that provider to ensure the kids are safe and supervised at all times. Given that the damage occurred when they were unsupervised on her premises, she should be somewhat (if not fully) liable for the damages. This damage is NOT due to your negligence so I don't think it should be your responsibility.

If this individual has auto insurance, I would think a claim could be submitted to the insurance company for coverage. If so, there would probably be a deductible - perhaps you could assist with that. Most deductibles are less than $700...but the cost definitely should not be yours to bare alone.

It is a tough situation b/c of the relationship you have with the "provider" but honestly, I don't think this should be your responsibility.

HI S.. Ooooo, tough one. What if your boyfriend brought it up to his Mom. Are your kids, His? If they are even better. He could say it with concern of the kids, like, " Why wasn't anyone watching them?" It's tough, at my Daycare where I used to work. Once the parent is seen at the school, the kids where their responsiblity, not the teachers. Good luck.

I run a home daycare...that repair is ABSOLUTELY NOT your responsibility! That is definately the daycare provider's responsibility. Furthermore, I'd be looking for new care.

I think this is a little ridiculous. I think they DEFINATELY SHOULD HAVE BEEN UNDER SUPERVISION. This wouldn't have happened had they been. Did this happen while your boyfriend was there, or during the course of time they were left unattended? If this happened while in her care, and you end up footing some of this bill, I think it's her responsibility to pay some of it as well. I agree this one is a tough/tricky situation, however, things need to be brought to other's attentions. If you are really nervous and not comfortable with them being left unattended then something should be said. It's a safety concern, and it only takes a moment for something to happen. My son will be 3 in September and there's no way I'd let him ever go unattended. Good Luck and I hope you figure this one out.
