ok I got into a wreck. Rear ended so the fault was on the other guy. The insurance company did a estiment on my car and i picked the body shop. Insurance company sent the check straight to the body shop. I needed a rear clip and he just did a patch job on it. And replaced the bumper So shop recieved $7000.00 for a $500.00 job. I told him along with the insurance company what needed to be done and he still did a patch job on my car. Everyone agrees that they would not concider my car safe for a nother rear end impact. I can't get the shop to fix the car right. and he will not give me any paper work stating what hew did to my car. the insurance company asked him for a recipt and the shop would not give them one either. So i would love to sew the insurance company for not making sure their investment wa taken care of. and the shop for insurance fraud. But i don't know my rights. Please help

Contact your state insurance commissioner here and file a case against the body shop and let your insurance company know what is going on.

My first question to you is when you got in the accident and you went to his insurance, they told you to go to a shop and get an estimate right?? where is that estimate? I can not see any ins company just handing over 7k on your word of mouth. The estimate should have included detail.
You should call your own insurance for some free advice and then tell them how you current car is not sage if it got in another wreck...they can give you better advice on what to do or take action themself..but you will first need that original estimate you got from the body shop

I would make an appointment with an attorney. He or she could explain your rights and, I'm sure, find out the information the body shop is refusing to share; and either get your money back so you can have your car fixed properly, or make sure the original body shop fixes it properly. (Possibly without ever having to file a law suit.) Also, I would report the body shop to the Better Business Bureau.

Contact the Attorney Generals Office in Oklahoma and make a complaint or the Insurance Board for the State. They must check out all complaints and will ask you for additional information so keep track of all paperwork you may have gotten, hopefully you have pictures of the car before the repair and if you haven't already done so take pictures of the repair work that this show has done, have a list of when you made calls to them, who you talked too, the date and time. In Arkansas you can make a complaint online and they will send you a postcard letting you know what the number is assigned to your complaint. Another thing I would do is report this business to the BBB and post an ad on Craigslist telling people to beware of this shop.

In a law suit like this one, you should be able to find an attorney who will collect his fee from the other folks being sued (body shop/insurance company) and you won't be out a dime. Call a local attorney (preferrably one that someone you know has used and recommends) and see if you could schedule a free consultation to discuss your options. Also, YOUR insurance carrier may take care of the legal action since it's on the car of yours that they insure. You might want to call your agent and talk to him too.

I don't think you need to sue. Just call your insurance company and tell them what's going on. (I am not clear if you've been talking to YOUR insurance company or the other guy's insurance company... but you should definitely be working through your own insurance company.) We were rear-ended and even though we had the other guy's insurance information, we just called our own agent and told her about it, she immediately started a claim and took care of us. At this point, the body shop committed insurance fraud and left you with an unsafe vehicle. Immediately, the insurance company should get your car into the shop and repair it. Then they can go back after the crook who worked on it in the first place. Bottom line, this is why you pay an insurance company - let them with their army of lawyers deal with this for you!
