What Kind of Attorney Do I Need & What's the Best Way to Find & Choose One?

In one of my earlier posts, I mentioned recently loosing a loved one, specifically my brother. BTW, thank you all for your responses and your many thoughts & prayers. I'm touched that so many of you took time out of your busy day to respond to my request. I found some great songs to add to my playlist even if they didn't make it in the video. Anyway, the challenge now is finding an attorney. I spent the first week and a half trying to find a probate attorney, but gave up in disgust because I didn't feel comfortable with them. And those were just the ones who bothered to return my phone call. I think I went about it the wrong way...just picking names out of the phone book. So now, I'm back where I started. I'm looking for counsel again, but I'm not sure what kind of lawyer to call. My brother was not married, but he has a young son. He had a life insurance policy provided by his employer, and he named his son the beneficiary. At first, the employer was doing everything they could to expedite the pay-out. Now it seems that they are doing everything they can to avoid paying it. My nephew's mother is at a loss, and I want to help her get what is rightfully theirs. I guess the best place to start is to find her an attorney.

To make matters worse, she was recently diagnosed with Melanoma! It's hearbreaking because they hadn't even had time to come to terms with her diagnoses when we lost my brother. She is scheduled to start chemo in a couple of weeks. Right now she's recovering from recent surgeries to remove the effected lymphnodes. She did not need the added complications of an avaricious employer.

Has anyone ever heard of an employer not paying-out the life insurance? What kind of attorney would know how to navigate the system? And finally, how do I find & choose one?

I am so sorry. I lost my sister in law at age 26 to cancer, and it is just a horrifying experience. You might call our office and see if you feel comfortable with one of our attorneys. You can call the state bar and get an attorney. There is also legal advice for free every second and fourth not sure what day between different times. The Small Business Ass gave me the information. Just not sure where I put it all. But I would start there. G. W

First, I had malignent melanomma and I'm fine 20 years later, though my lymphnodes were not effected like hers. But tell her not to worry, just get treatment and if she needs more info on that, try contact Dr. John Nemunaitis at the Mary Crowley Clinic in Dallas or just google him.

Second, and Estate Attorney could help.... It's best if you know someone who knows someone that's used one. Elsey & Elsey in Flower Mound is one that a friend used and they did a great job for her.

I am not an attorney, but I was thinking the insurance question might be that the company wants to pay it to the beneficiary... which is the son, not the mom. So a trust might need to be set up to hold the money. It isn't hers to spend...or at least not freely, she can probably get it set up to take money out for her sons needs/expenses. That's just a guess. I really don't know.

I am so sorry for your loss. A co-worker of mine has a husband that is an attorney. That is who we used when my husband's mother passed two years ago. He is very thorough and we plan on using him again when we do our will. He even did some investigating for us since we didn't know a thing about probate or how it works. His name is P.
