Terminated from Employment

I was terminated from my job on 4/17/08. I worked as a Store Manger for Gamestop Inc. According to the company I failed to follow a policy and procedure. In my year and a half of employment I had always done the thing that I was accused of doing and never once been warned that it was against policy. Nor was it ever stated in any manual or handbook that it was against policy. I intend to fight my termination. Can anyone recommend a lawyer who would be good for my case or give me any advise on how to handle this? Thank you in advance for any assistance.

So What Happened?

I was unable to fight my terminatin because it was not race or gender based. I have found other employement, I returned to a company that I had previously worked for in a lesser position. We have apllied for Chip for the children and are utilizing Cobra for my husband and I until the new benifits kick in. I am still hurt by what happened, but I will get over it. Thank you all for your support.

J. I have been there and to be honest its really not worth the effort. The money you will spend in attorney fees and the time and worry,to me is just not worth it. You can file for unemployment and if they deny that then look into fighting that aspect of it.If the company denys your claim then you can then request a hearing that allows you to fight your case with an unemployment representative present and then they can rule in your favor and you can win that way instead you will be prepared with proof and be prepared to fight the battle and get your full unemployment benefits and get to stay at home with your family and then look for a better and more satisfying job somewhere else!

Hi J.,
My advice-if you haven't already done so--open an unemployment claim right away. You are probably angry, hurt, and all kinds of other things. Make sure to get your compensation moving asap. You're entitled to it.

Pennsylvania is an "at will" employment state, so unless you think it was related to your sex, there's probably not too much you'd be able to do about it. If you think you were treated differently than male employees, you should probably file with the EEOC, the State Human Relations Commission (http://www.phrc.state.pa.us/)
or the City of Pittsburgh Human Relations Commision, depending on where you live. Hope this helps and good luck!

Based on the information you provided, you may have just cause to win an unemployment appeal, but you do not have a case for wrongful termination. Termination can only be unlawful when it is clearly a case of descrimination against a protected class.
