we had a baby in aug 2008. does he qualify as a resident for the year even though he was with us less than half the year? can we claim the child tax credit, dependant and eic? i am not finding clear answers online but haven't called anyone yet, thanks!!

You should be able to. When I had my son in November of 1999, we were able to claim him. So you should be fine to claim you baby for 2008. :)

Yes, you can claim him. It doesn't matter if he was born December 31 or January 1, the 6 month rule only applies in custody situations.

Yes you can claim him. I have a little girl who is 15mo. I had her on 12/12/07, and because I had her before midnight of the 31st of December 2007 my husband and I got to claim her for the whole year. But, in order to do this you have to get a social security number/card for him. Plus if you have any questions you can call the IRS directly, there is a contact us number on the website www.irs.gov and there is also a page that will help you find a site where you can file your federal AND your state taxes for free on-line (makes your return up to a month faster than snail mail.

Yes, as long as the child was born before 12/31 you can claim them for the tax year. Make sure you bring the baby's social security card and any daycare info. You will need the provider's tax id # as well.

Absolutely! My son was born December 30th, 2007 and I claimed him on my return for that year and qualified for all the tax credits that come with that. It's based on the year of their birth, not the actual birth date.

We had a baby 12/01/08 and my HRBlock guy told me yesterday that as long as you had the baby by 12/31 11:59pm, the baby "counted" for the whole year! :) Congratulations on your 7 lb. tax deducation!

Congrats on your new addition. I had my youngest December 8 of 07 and I called the tax people they said as long as the child in born before December 31 at 11:59 pm you can claim the child. If you still have questions I suggest calling somewhere like H&R Block or something. They will give you free advice. Good Luck!

Congratulations on your new son! In answer to your question: Yes, even if he had been born on December 31, he would qualify as your dependent and for the eic and child tax credit for the whole year. This is why some people would rather have the last child born in a year than the first child born in the following year.

Hi L.. Yes your child qualifies you for the child tax credit and EIC and dependent care. And he is a dependent and will give you 1 more exemption on your taxes. I'm a CPA, I don't do taxes as my day job but do them on a volunteer basis. Below is a link explaining some of this. The question in the link doesn't apply to your situation but the answer does.

I had my son in August of 2007 and I claimed the child tax credit. I use H&R block on-line using the long form it takes you through step by step.

Yes you can totally claim your child for everything. Even if he was born december 31st

I know that you can claim your little on on your taxes....because my daughter was born dec 29 and all the nurses kept saying oh she just made it for the tax credit.\

If all else fails call H&R block and ask them or call gilbert sanchez tax expert they should be able to tell you for sure if you can claim your baby or not. Im pretty sure you can though because it was before april of 08. Hope this has helped. L. ashe stay at home mom mother of 4.

Hey L.,

I had a baby 12/31/07 and I claimed her when we filed our 2007 taxes. That was the running joke at the hospital, she made just in time for a tax deduction! You should have no problems claiming your baby boy.

You absolutely can, our older boys were born 8/1/ 05 & 7/23/07 both were claimed the year they were born, you must have a ssn for him in order to claim him though. Our latest was trying to come before the end of the year but did not make it until 1/9 so we have to wait for next year :(
