Medical Leave Question??

I am not eligible for FMLA, however have been placed on a medical leave for 3 months by my doctor. Am I able to work a very low stress, no responsibility type part time job??

What can I do next?

The best person to ask about that is your Dr. It would depend on why he put on you medical leave.

Your doctor will need to release you to return to work and specify what type of work you can do and for how many hours per day.

Depends on your medical restriction. If it is is completely no work, no you can't work at all. If the excuse states part-time, light duty then yes you can IF your employer is willing to accommodate. Most accommodate if they can for work-related injuries but for non-work related issues they do not....this is not an absolute but definately what I have seen in my HR experience. You can not take medical leave from one employer and work at another during that leave or you would forfeit any short-term disability you may otherwise be eligible for.

I'm going through something similar currently, I was injured at work though so it is disability. Are you still employed by the company you were with at the time of going on medical leave? If so, it is up to the company (HR) to approve a modified work schedule or duties. If you are at the same company, you can't obtain other employment and still receive disability payments (if that's what you are receiving). Good luck!

If your doc says no work then don't work, especially if you are getting any kind of income for the leave, such as workers comp or anything that is going to be litigated. If you say you are unable to work to sue someone but are working you would be committing fraud. I imagine that's not the case here so I say ask your doc.
