Legal Advice for My Child Being Bullied in School

help,what should i do i have taken all the right steps to help my child it seems as if the system is so over loaded that we are being pushed aside and my child is now retaleating and being punished in all the wrong ways

Have you taken this to the principal?
To the school board?

I'm sorry your child is going through this and I don't really have any legal advice. I just have heard you have to take it up through the levels--teacher--principal--school board, etc. And document EVERYTHING.

You're not giving enough details about the situation including how you're defining "bullying" and "retaliating." If your child is being physically harmed or your child is being consistently harassed and the school isn't doing anything about it (and it's occurring at school) then you can file a police report and press charges. If it's happening off campus (aka not at school) you can either approach the parents directly or just call the police and file a report and press charges.

Don't make threats to other children and don't encourage your child to go after anyone. Let him/her know that self-defense is acceptable, but the best course of action is to get away and run to a safe location like the school office (if at school) or home.

You can also call your police station's non-emergency line and ask them if they have a program or officer available for your child regarding dealing with bullying.

A friend of mine from high school has an amazing daughter. She was one of a small group of Upward Bound youth that heard the story of how a young man shot and killed himself due to being bullied. The group decided to form an organization to promote unity against the bully's. It is a huge movement now and is all over the world. The family go to schools and talk about what happened and how the students can stand for each other. They may have some ideas of what resources are available to the family of children in this type of environment.

Don't know based on the limited info you provided. You need to first know what the laws in your state are regarding bullying. It wouldn't hurt to speak to an attorney. I am assuming that you have exhausted your options with the school leaders/teachers?

Please outline what is going on and what steps you have taken so that we can give you a more comprehensive answer.

Please include
Age of your child
age of bullies
# of bullies
specific instances where you felt your child was bullied
How your child reacted
What happened to your child (punishment you indicate from retaliation)
What you did - conversations with teacher/principal etc.

From this point on, I would DOCUMENT - take pictures of online stuff, or communicate with teachers / principal via email.

You are your child's biggest (and, unfortunately, sometimes only advocate). So don't allow yourself to be "pushed aside" if you feel your child REALLY is being bullied.

It would have to be something VERY severe for me to get the law into it.

Can you be a bit more specific and add more details? Ages, types of bullying he is experiencing?
