Lawyer Needed to Sue an Attorney

I was in a car accident 8/2001. I hired an attorney in El Segundo who ended up dropping the ball. He didn't do anything on the case for a couple of years which I was told was normal. I went out on tour for 2 years and did my best to advise him when I would be in
town for depositions and he never set anything up. I contacted another attorney during this time to see about switching and he said there was nothing to worry about, these cases were often dealt with at the last minute. I came back to town and contacted him several times without good result. Then his secretary missed a filing deadline. The case was dropped by the courts and she panicked. She trashed the notice instead of giving it to him. He contacted me and offered to pay out of pocket. He started to send payments, but when I tried to pin him down on a final settlement number, he evaded the issue. I have not heard from him and would like to find an attorney to take this over. I live in South Bay area. I am not seeking to crush him, only get just compensation.

What can I do next?

Go to martindale.com and do a search under "legal malpractice". You can also contact the State Bar (look at calbar.org under "Public Services") and see if they have any referrals.

It is very far from the truth that the state bar is the only entity that can sue this attorney, as one of the other responders stated. The state bar can disbar an attorney and prevent him or her from practicing, but that is different from suing. You can, and should, sue the attorney yourself. No one else is going to look after your interests as much as yourself.

First file a complaint with the ABA american bar assc, if you dont he will do this with others, then I would file a small claims against him, send him a certified letter, asking him to settle this with in 7 days or this will go to the aba asc, and you will file small claims on him

I have an excellent attorney named Joseph Nardulli who is in Irvine. He doesn't do Personal Injury, but if you are just trying to get the first attorney to submit the claim to his Errors and Omissions Insurance, then he should do this. As I said, he is excellent. His number is ###-###-####. Tell him L. Simmons gave you his name.

At the risk of sounding psycho, I would love to see you crush him. The stories of the lawyer hired to help ending up being the bad guy are way too frequent. I'm certain you paid all his bills along the way too!

You need to Call the State Bar of California and file a complaint. By the way, they are the only lawyers that can sue attorneys for mal-practice. They will take over everything for you, investigate and argue in court and there is no cost to you.
