Injured at Party City

I was shopping at Party City two days before Halloween. I was walking down the aisle pushing my infant in her stroller when I was struck by a dolly on my achilles heel. The pain was intense and an accident report was filled out. I went to the doctor the next day to have it checked out. (I am a diabetic and have to be careful with my feet) They said we needed to watch it, that it is a dangerous place to get hit. Since then I have started feeling a popping sensation when I rise up on my toes. I have extreme pain when I get up to walk after I have been asleep or sitting down for any length of time. I went back to the doctor and he said will was still swollen and the injury has caused plantar fasciitis by tearing the fibers leading to my foot. I DO NOT think I should be paying for these visits but I can not get ANYONE at Party City to contact me. I have tried many times to call and have emailed HQ 3 times now. I have no idea what to do now. They are responsible for this and should take responsibility! I want to know if anyone can recommend a good lawyer that will only accept pay if we get anything from them. I can not afford to pay one, or my doctor bills for that matter. Please make sure they are decent human beings, thanks.

Contact their parent company, Amscan Holdings, Inc., and ask for their commercial liability carrier's contact info, or their third-party administrators (TPA) contact info for their commercial liability policy. I would not give them many details, just say you need the contact info. I did a quick Google search and got this info:

Again, give as little info as possible, just ask for that information. Even if you email the CEO, don't dwell on your story (though it is quite sad, they should have given the info to you before you left the store). You might want to do a more thorough internet search for that info as well.

At the end of the day, you just need to set up a liability claim against them since you were injured in their store. You don't need any attorney for that. If you are still having trouble and/or you will have to pay out of pocket and then they reimburse you, you may then want to get an attorney. See what you can do for free, first. Good luck!

I was in a major 5 car accident and I used an attorney. It dragged on for 5 years, but finally got 3 different settlements. Here's his contact info:

He was very good. I had to do 2 depositions, but my case was settled out of court. It was a mess and very complicated, cause I had other medical issues and surgery done on my elbow during that time as well. He specializes in accidents/injuries. I'll be honest, a lot of times I had to talk with his Paralegals a lot of the time, cause he was with other clients or in court,etc... He does go on contingency basis, so you don't pay him unless you get a settlement and he gets a % of it in the end.

I now have Pre-Paid Legal, so I have access to attorneys, 24 hours a day, if needed in an emergency situation. The customer service is great, cause you get a return phone sometimes within minutes of calling them. You talk to Attorneys, not Paralegals. It may be something you want to consider in the future. We've saved over $7,000 by having their services. I have access to attorneys in each state as well. It has been a lifesaver, having Pre-Paid Legal. I wish when I had my accident that I had Pre-Paid Legal then. It would have saved me a lot of hassle and frustration in finding an attorney and might have saved me money on my case. It is a peace of mind, you never know when you will use it. It is like Life Insurance, you never know when you will need it.

If you have medical insurance, let them know where it happened. They will be a huge help. I once fell at a friends house, my own fault, no one was around, I tripped over a step. My insurance company demanded to know where I was when I fell, who's property, ect ect. Of course I never told them where I was, it was not my friends fault, but insurnace was ready to go after them.

Since you have a preexisting condition and already admitted that feet are a major concern to diabetics. Move on.

I can already see the counter argument....Pre-existing or diabetic related issues. It has also been months since the injury.
