How Do I Go About to Collect Child Support?

I am a singe mom of a beauitful 8 month old daughter. In janurary I filed for child support and in May the court made ordered my babys dad to pay child support as of Febuary 1, 2007, 800.00 a month. Does any one know how I can go about to collet the child support. I went down to the child support office two weeks ago and gave them the minute order.But I still haven't gotten any payment.

So What Happened?

I have been going every week to the child support office as of January and still haven't received my child support payment but as of yesterday my babies father gave me a check for one thousand dollars. Even though he owes 5 thousand in back pay. But I was happy that he finally gave me something..since my daughter will be one next month. Thank you everyone for your advice..It really helped.

You may not see it for a while. Is he actully going to pay it is the question you should ask?
Does he make a lot of money? He must to have that much granted to you. If you do not see anything in a month call again. The problem is that it takes a while for the system to catch up with the father.
Sad thing is that they can stop paying too and then you get nothing. Then they have to pay a portion of back pay. My sons father didn't pay for 3 years and now his back pay is $24 a month. So do whatever you can to provide for you and your child. Try not to rely on the money that is comming from him. Live on as litle as possible and save what you can just in case.
You deserve that money.You are raising the child so keep on Child support, but remember they are not th bad guys they are trying to help you so whe you talk to them try to treat them as respectfuly as possible. Not only is it the right thing to do, but it makes them more apt to help you.

you need to contact your local child support office ###-###-#### in oc) at least ONCE A WEEK... give them as much info about your ex as possible including work address, phone # etc...

you can always try what my mom did when she was going after my father for cs, contact the A.D.A or the D.A. and arrange a meeting with them they seem to do alot better job going after the father then the cs agency.

My friend just went through this. She was told that although the order is retro-active, his first payment isn't due until a minimum 30 days after the court order, and it is often pushed to "the first day of the month after 30days from signed order." Meaning- if it was signed May 3nd, 30 days would be June 2nd (May has 31 days), but the first day of the month AFTER 30 days is July 1st. SUCKS, I know! PLUS, if the court did not include when retro-active pay is required to be paid in ful, he can take until she is 18 and is no long required to pay CS. BTW- does the order state that he MUST pay until she 18 AND graduates High School (or better, College)? If not, she is an adult at 18 or Graduates, and he no longer has to pay! Again, SUCKS, I know! If you've already had to fight for CS and she's only 8 months, prepare yourself for 18 YEARS of court hearings. On the other hand- once the CS is past due, state of CA will suspend is license and if he gets pulled over he can be arrested. Sometimes HIS ignorance is YOUR bliss! :O)

If these things weren't covered in the original order, talk to your lawter about why not. Also see if and when he/she wants to file an OSC (Order to Show Cause) to have the CS ammended or changed. (I.e. If your child care cost goes up, sometimes you can get more CS to cover the difference.)

Dear J.,

There is a place besides the courts to retrieve your child support. as long as you have a court order ask them about helping you. cildsupport.com they will help you and to make sure he pays.
They also have commericals as well. I wish I could help you on this but my son's father never paid me child support ever. And now my son is going on 19 in July. So I truely know how it feels to support my children all by myself. Except now I am getting childsupport for my 12 year old. But he refuses to be a part of her life. Which is a very sad situation. Some pay and some don't. But even if they don't at least be a part of their lives.

im sorry to say this but get in line behind the rest of us. its sad that there are men out there like this but there are. you are just gonna have to deal with the child support office and the court. they have to find him and serve him or find his job and take it out of his wages. all of this stuff takes time. it seems like a pretty easy process but its not. you just have to wait. youll get it one day.

it takes a while, depending on what state ur in! the department of child support services can help, it will take a while but they can help with everything . he'll have to pay them and they'll pay you. really tho he can pay you directly, because once the DCSS takes over it will retro to date of order. ..but it has to be an order, not "minutes".

Dear J.,

Go back again and again to that same office, always be polite, and explain that you need that money - that you are going to school, and when can you expect to receive it. Maybe they will give you a welfare grant and then use the child support money from him to pay for that. Be patient, but persistent. Do not lose you temper, but you could shed a tear or two if you feel like it. Ask them what else should you be doing. They have to answer your questions, so keep asking them. Write to you State Senator, and State Representative. You can get their phone numbers and addresses from the phone book. Hand written and neat is just fine. Don't let a lot of time go by without checking with the Senator's office or the Representative's office for when you will receive an answer to your letter. While you have them on the phone, ask them what else you can do, that you are going to school and have no other means of support at this time. Good Luck, C. N.

Sorry to hear your not getting the support. It depends on what info they have. It depends on what county you live in. Larger counties take more time. If they know where he works, they'll issue a wage garnishment which is mandatory for the employer to comply with. It is illegal for an employer to fire anyone because of wage garnishments, but it doesn't stop some of them. I live in a large county and the only time I got support was when I happened to find out where he was working. My husband however pays child support in a very small county, and it doesn't take them long to start garnishing even without volunteered information. In the meantime child support owed is adding up, and interest as well.

It took me 3 months to start getting checks - just keep ontop of the child support office and make sure they are working on your case and don't need anything from you. Once they get it set up - you will be okay, but it does take them time to get things going and to find dad's paycheck.

Hello, J.!

The child support office should have asked information from you about your Daughter's Father. If you gave them sufficient information you can get paid the child support through wage garnishment. That's how I was able to get my child support. It did take a long time for it to finally kick in, though. You may have to wait a while longer. I suggest to keep checking in with the child support office & follow-up. Also, you might not get as much as you are hoping. All the missed payments will be accumulated.
