Does anyone know of some of the "rules" regarding grandparent visitation? My brother lives out of state and his exgirlfriend and their daughter live in state. His ex-girlfriend doesn't let my parents see her and hardly ever lets him see her when he comes to town. My parents are interested in options regarding this. Let me know if anyone has dealt with something like this. Thanks

grandparents have no rights in the states (with an exception of only a few) to get visitation. If the father of the children gets his visitation, then he would be then responsible for visiting the grandparents when he has the children.

I'm not a lawyer so I don't know all the laws, but I do know that grandparents DO have rights when it comes to visitation. My husband had a lot of problems w/ his ex not letting his parents see his daughter. They even hired a lawyer to make sure they got their visitation. It is in his custody agreement that if he can't make the visitation then his parents automatically get the time. If it continues, your parents may wish to consult a family law lawyer to see what kind of options they have. They may only have to "threaten" the girlfriend w/ the lawyer in order for her to allow visitation. Good luck to your brother.

Grandparents do have rights in certain circumstances, which always take into account the best interests of the child. MN law on child support just changed dramatically in 2006 so it it possible that parenting time/visitation has changed as well. The best thing you can do is get the mother to amically agree to allow the child to see the grandparents. If she won't, then they should contact a family law atttorney to find out if they do have any rights in this case. There is a Supreme Court case that says giving "rights" to grandparents would necessarily intefere with the parents right to raise their children how they see fit, even if it includes shutting out grandparents. Thus, it would be a really tough sell, but as I said MN law has recently changed and they might have a shot. Good luck!

I believe they can take her to court and fight for visitation which they should get unless she can prove their unfit or something bad.

They just had on the news where a lesbian couple broke up and the one girlfriend who wasn't on the birthcertificate but had raised her won visitation.

I have heard that there is a law now that grandparents have the right to see their grandchildren. If your parents are having difficulty with visitation, they should ask an attorney about this and there may be some type of mediation or something that they can see the children without their mother around. I know how I feel about my grandchildren and not seeing them would be painful.

Grandparents do have rights in the state of MN. My husband was in Iraq and his ex wouldnt let me see his son so my father-in-law said that he would take him when he could so i could still see him. My husbands ex and my FIL dont get along at all so we talked to a lawyer just in case she didnt let him take the child and the lawyer told him that as a grandparent he has rights to visit that child and he can go to court and have set visitation times if he would like to do that.
