Fraudulent Credit Claims

I have read all the requests in the legal and financial, and have not found an answer for my problem. Just a few weeks ago my husband and I turned in an application for a mortgage, and were turned down. In looking at our credit report we found that there are claims on there that are in complete violation of the contract we signed for the services we are now being charged for. One example would be Verizon. We got cell phones through them, and ended up canceling early. We paid almost two hundred of the $350 needed to cancel, and somehow they have added over $390.00 more to the bill due to canceling- bringing us up to $690.00-200.00 we paid. We have called them and constantly gotten the run around, and they change collection agencies almost as much as I change my clothes. There was an apartment my husband rented in college that he left early, the contract said that they would keep his deposit. They are now charging him for the three months of rent he didn't pay (there are no provisions in the contract granting them the right to do this, and there were no cleaning fees listed on the report). These are just a few of the things we found, and I am wondering if any one has ever dealt with this sort of thing. Right now we are battling with Sprint because they say they sent us a cell phone that we never signed up for, and the collection agency will not stop calling. I will not pay more than I have agreed to these places. One of my friends said that I can take these people to small claims and charge them with harassment, making the judge cancel the claim they have against me (which getting money from them is not the priority, just cleaning our credit so we can buy a house is). If any one knows or has any advice on how to take care of these things I would really appreciate it. I have tried to reason with many of these companies, and even in faxing them the contract they had with us, knowing they are not entitled to make these charges, they will not admit to their wrong and drop these things.

So What Happened?

Well, I am still waiting on my husband to get his full credit file sent to us. I did find that the sites listed here were REALLY helful, and I have forwarded them to more than one of my friends. I also downloaded some letters I found that are listed on a site with credit repair for dummies. I will be filling out those letters and sending them as they site exact laws and where they are found.

I worked as a mortgage processor for 10+ years and we saw things like this all the time. If you have already callled and faxed contracts and such with not results I think that you need to get an attorney involved. It usually just takes 1 phone call. Make sure that they answer all your request in writing and keep everything! They will most likely report the same old imformation back to the credit repositories within a few months and you will need to send information to the contrary.

Have you filed a complaint with the credit company also? You can dipute the charges through the credit company you recieved your credit report from. In your explanation you need to tell them of the terms and what has happened. They will also open an investigation.

On our credit report, we had several issues that were not taken care of. We disputed it with the credit company, they contacted me and they did an investigation and took the bad credits off there. If that doesn't work then you need to hire a lawyer. That website is a good start also that the other mom mentioned. Good luck, but this will take some time.

Hi...I would recommend sending this email on to Suze Orman, I guess her website would be suzeorman.com. She always has fantastic financial advice; I'm not a person who likes to deal with finances or listen to people talk about it, but she is very interesting and really knows what she's talking about! Her show comes on Saturday nights on MSNBC. That's what I would do, anyway. Good luck!

I highly recommend you get a laywer. The cheapest way to do that is through a company I use myself called Pre-Paid Legal. You pay a one-time $10 enrollment fee, then you can get identity theft sheild for $9.95 a month and the basic laywer help for $17 a month. We have both and it's been such a blessing. We have a laywer we can call anytime for any questions we may have, plus they will help us in a trial or with any legal documents (like a mortgage) that we want them to review! I have used them several times, plus they will do your wills for you for free!!! You need the lawyer right now, and if you go over the 60 hours of trial coverage, you'll get 25% off their fees.
With the identity sheild, you get them to moniter and restore future bad credit (they won't do pre-existing). However, once the lawyer helps restore it, they'll make sure it stays that way by e-mailing you monthly reports and if something happens, you tell them and they do all the work to fix it! Personally it's a relief for my family not to have to worry about it!

Hi Amanada,
I hope that I can help you get this solved. I worked for Cingular Wireless Call Center. Call the phone company Sprint and speak with the fraud department and let them know that you didn't sign up for the service and your identity was taken. They should handle all items including the credit company and the calls should stop for Sprint.
Call Verizon and speak with the cancellation department if there is one. Ask when they have you marked for having canceled your service. Let them know that you wanted it canceled on the date you called and find out why the extra charges were add after the fact that you told them to cancel.
Don't know what to do about the rent situation. Good Luck and hope this helps.
