My child was going to this daycare where the person wasnt providing the service of caring and watching my child. I go to pick her up from daycare on fridays and her boyfriend or 11&13 year old children are watching the kids. I pick her up and she has on a dirty diaper that has been on her for a while because the poop is stuck to her behind and it has started to turn white. This has happen more than 3 times. She leaves the children with her boyfriend while she goes and get her hair nails and toes done. This one incident was my finally straw with her because she left the kids there with her boyfriend but he was outside talking to his cousin while the kids were in the house. He said they were sleep. but when he went and got my child he had to go to the back of the house to get her. She had been crying and she was fretful. She had on another dirty diaper which had been on her for a while. The poop was stuck to her and her behind was red and irritated. I dont think I should have to pay her a two weeks notice because she wasnt providing the service she was suppose too. But the money is all she wants and I dont think she should get it.

absolutely not. she would get none of my money. She would get a call from DHS. That a 11 & 13 year old are watching more than 1 child. it is actually against the law for the 11 year old to watch any child.

I also agree that you don't need to pay her. I also urge you to report this situation to Child Protective Services. Do you know if she's state certified to provide daycare? If so, also report this to the State Human Services Department that does the certification. You can find both numbers in the government section of your phone book. The CPS Hotline number should be on a front page of the phone book.

While looking for new daycare be sure to ask for documentation that the day care provider has been state certified.

You need to decide what is best for you - pay her and be done or don't pay her and she may take you to small claims court. You may not end up paying if it's decided that she broke the agreement first. But you can never be sure how these things will turn out. In the process you will spend a lot of energy for a longer period of time. Either way I would report her.

I would have taken her out of there the first time that happened, or absolutely by the second time. You are paying her, not the boyfriend or teeny boppers. There are way too many stories of boyfriends abusing children.

You should probably pay her what you owe her if you have a contract, and be rid of her. Although, her negligent care would probably be considered breach of contract. If you have evidence of the neglect (the specific days written down, a picture of her bottom, etc.) then that would back up your claim. Do other unsuspecting parents a favor and report her to whatever authorities oversee her, if she is even certified or licensed by the state.

Take her out of there immediately! My daycare lady occasionally has her husband watch the kids when she has a doctor's appt or something, but we are warned well in advance in case we aren't comfortable with it. If your contract says 2 weeks notice, point out that your contract (i'm assuming) also says that she will be the one providing care for your child, not her boyfriend or daughter and she was in breech of contract first.

First of all she is lucky you don't report her to the authorities for endangering the welfare of your child, or any child. Second, who knows who this boyfriend of hers is he could be god only knows what. I would report her to prevent anything from happening to any other children in her care. You are lucky your daughter was never hurt, someone else's child may not be so lucky.

Do you mean this has happened every Friday? Were you aware that someone else would be watching your daughter? I have a home daycare and have left the daycare kids with my kids who are 16,13 and 8. This has only happened when parents have been late or past 5:30 and one of my kids has an activity that they must attend. I think this is fair since it is the parents who are late!

I would definitely move your child from her care immediately, there is no excuse for dirty diapers that long, unless it happened just before the child went to sleep and she didn't realize it, this has happened here, but it still shouldn't be that stuck on or turning white. I don't think you should have to pay but I would also report her to the agency so other moms don't have to go through the same thing. If you don't say anything, other children will also suffer in her care.

Pay her and get out. It isn't worth the time. Just find someone else and let her know that you found her care substandard.

She should not get it, and she should be reported if this is more then just a person watching your child.

If you didnt' sign a contract, she doesn't get the money. If you signed a contract, you legally have to. Leave and report her.

She hasn't been doing her job, and she's endangering children. It would be great if you documented all the times there were issues.

First of all you need to take off work if need be to ensure your child NEVER goes back there. Then you need to warn other parents of the issues so that their child is not in danger. No way would I give this person another penny! Find someone else to watch your child yesterday! You could also file a report; if they are licensed in the state then they need to be shut down ASAP!

If you signed a contract with her that requires two weeks notice to cancel services, you are technically required to pay her. However, if you can document where she breached the contract by allowing other to watch the children when she was not even present (especially if they were not her trained back-up providers...usually they would need the same training as her) then you should be able to write a termination letter stating the facts of the reason you are pulling your child from her care. Be sure to specify that since she broke the contract by not being the one that was carrying for your child and subpar care being provided/your child being neglected you are no longer in need of her services effective immediately with no advance notice. State that since she has already severed the contract, you are no longer under obligation to adhere to it and therefore also do not owe her payment for the two weeks cancelation. Have it notarized (have two notarized so you have a copy) and give it to her.

If this is ongoing then she needs to be shut down. It doesn't matter if you signed a contract or not, she obviously wants the money, but you have to pay upfront for your childcare starting as soon as you find someone. I say just never go again to her place of business, report her, document each occasion as best as you can on paper now, including dates, who was present in the house, who was missing, who was extra, etc...she would really have to be an idiot to take you to court for back child care payments, she's not going to want your statements as part of public record from a court hearing...;

I would report her to child welfare and don't pay her. She does NOT deserve the money. Give your little girl a hug from me..if thats ok.
