I'll reserve comment on what a SLIME your ex husband is, on oh-so-many levels, and tell you what you asked for...

1) Look up the address for your local county courthouse location for CIVIL actions (there are three types of courts: family, criminal and civil -- you want civil).
2) Go to the courthouse, find the clerk's office, and request the forms you will need to change your daughter's name.
3) Take them home, fill them out. Gather all other necessary documentation -- your daughter's birth certificate, and possibly a notarized letter from your ex that he agrees to this name change. MAKE COPIES OF EVERYTHING.
4) Take this all back to the courthouse. At this point, you will be given a court date to see a judge.
5) Go in to see the judge and explain why you want the name change. It will be granted, trust me!

You can go to the selp help clinic at the court house and they will tell you how to it and give you the paperwork.

call your county clerks office. If they don't know, they can direct you. No way should you need a lawyer to do a childs name change. Unless, your ex is being a jerk about it.
Even still, I would think, you file to have it done, if he doesn't sign the form, if he needs to, then take him to court.
What judge would deny you this, based on the circumstances?
I'd say, first, try to just do it. If he needs to sign, and does so, you just pay a fee, $10.00 to $20.00 dollars is my guess, and file for the name change.
One of my 18 year old students just changed her name. She went to court. Stated the info. and then had to wait a couple of weeks.
If worse comes to worse, perhaps go to the library, reference desk, and ask for leads for free legal advice.

wait, I just looked it up in the catalog of the Mt. View library. They don't have it in stock, so you will have to print out the page below with the ISBN and book title
and ask the librarian to help you out with an interlibrary loan. Problem with ILLs is you only get the book for a month. You might want to go to one of these library's

As you live in Mt. View, you could just go to the county seat (downtown San Jose) and ask the clerk for the forms, but I would get the book from the library as it looks like it give you more advice.

Go to this website: http://www.sccsuperiorcourt.org/probate/default.htm It will give you all the info you need to do a name change. I did this for my two kids -- you can do it yourself and you definitely don't need a lawyer. It's through Santa Clara County, Probate Division -- they handle many things, one of which is name changes. Good luck!

I think you can go to the courthouse and fill out some paperwork and pay a nominal fee. I don't think you need to get an attorney involved.

If you live in or around San Jose you can find most legal forms at Rose's printing (they generally have instructions on what you need to do with the forms)in downtown San Jose. Otherwise check your local book store for a book of legal forms. Good luck
