I have a question, yes! I am the mother of two girls: One is 16 yrs old and one is 3. I have lost most of my family except my dad...my mother, sister, and brother are deceased. My dad is 73 yrs old, and his health is failing.
The subject is, of course, about the well-being of my children and where they should go if something should happen to me. I want them to go to my best friend Kath's, as their legal guardian forever. My question is, if Kath has a record of DUI's, and having to go through an alcohol/drug program, can she still be to the children what I request, and how should I have it legally documented? A living will? Would it work just by me leaving a written statement that that's where I want my children to be with? (Kath is totally OK now, it's been awhile since her troubles and she is the most loving, responsible, caring woman for my children, she genuinely LOVES them. She's been around the baby since day one.)
