Family Trust
Hi moms. I need advice on a family trust. I want to know if this is a good idea? Why? And if so can you recommend a trustworthy lawyer who could help me with the process? I have heard a lot of people do this when they have kids but I need to understand why a will where I leave my child/children to one person and the finances in the care of another person I trust is not enough. Any advice would be appreciated. Thanks.

We went through Kuhn Law on Jefferson in Naperville to setup our trust for the kids. The phone number is 630/355-1700 and ask for Amy Kain. She was wonderful and explained everything to us in detail (she specializes in trusts and wills). Good luck!

Hi L.. Just find a lawyer you trust and talk to them to see what you need to do. We did a will, power of attorney for health and power of attorney for finances. You just definitely want to get your wishes in writing so that your estate and children don't have to go thru probate with the state. My family has used Jim Russ of Wiedel, Hudzik, Russ & Philipp out of Downers Grove for years and years. They are on Main St. and their number is ###-###-####. Good luck!

You need to find a lawyer who does trusts and talk to him/her. The recommendation to do this has to do with laws in Illinois vs logic. My father put his estate in land trust, directed by the will, and it saved so many hassles...and money. Even if you have a trust, you also need a will to direct it, as I understand. But then, laws change all the time, so you really need to talk w/a lawyer. Here's an attorney recommendation in the Western Suburbs: Michelle Chase, ###-###-####.

Hi L.,
The main advantages of a family trust (at least the way I understand them) are:
1) They don't have to be probated which save family time and money should something happen to you
2) All assests go into the name of the trust and there are rules about how and when those funds can be accessed by the trustee.
