Divorce Online

I did not file for divorce online, but if you are in Tx you can do it yourself for around 200.00. There is a website called texaslawhelp.org and you can print out the instructions and the forms for free. It also has a form to make it free if you cannot afford it. Good Luck! Both my sister and I used this and it was great.

It depends on what county you are filing the divorce in. Plus, to file online there is an additional fee to the original filing fee. You will still need to draw up (or have an attorney draw up) the Original Petition for Divorce. If you use the Case File Express Website you will need to save the Original Petition as a pdf.file before you upload. You will also have to create an account and make sure that they will allow you to file as Pro Se.
The easiest thing would be to get an attorney to take care of all of this for you, but if you want to do it yourself it is probably better to send in a paper copy and work with the court. If you aren't familiar with the divorce process and the rules of the court it can get pretty complicated. If you have kids and/or property my advice is to hire an attorney to help you.

If he's wonderful, why the divorce?

I agree with others that an attorney is recommended if there are children, property, assets, etc. that would require any type of negotiation.

However, if the divorce is amicable and you have agreed on who gets what, filing it yourself is the most cost effective option (rather than filing online with extra fees). I drafted my own papers using the free forms which I found online. I filed them with the court and in 90 days, it was over. My ex initially had an attorney that took over a year and couldn't even file the papers in the right court, much less get anything accomplished.

I ran into a snooty court clerk that told me if I didn't understand their processes that I needed an attorney, when I was doing what another court clerk had told me over the phone. Other than that the process was fairly smooth.

A., my advice is DON'T do it. I tried it myself this past year and it was a waste of money and time. The court would not accept my documents and told me to get my money back (which I was unable to). I now have to spend additional money and resubmit my papers. The judge said for me to get an attorney to get my papers done right. Don't believe what they advertise online. Good Luck!

If it were just a couple, they had nothing to fight over, no property to split, etc then maybe.

Someone with children, property, or any money at all would be a fool to divorce on line. It is worth the money to have representation even if you have to pay it out. Once you are screwed in custody issues - it's hard (and expensive) to fix. Just my opinion...
