Child Support - Fort Worth,TX
my mediation was moved to january next year but temporary my soon to be ex was ordered to pay child support he owes me over 5000 now i called the attorney general they say they cannot take money from his check until divorce is final does anyone know what paperwork to file in court to ask the judge to make him pay i cannot afford an attorney at all.ex has money but just don,t wanna pay

I have a good friend that is fabulous and a family attorney. I know you said that you can't afford an attorney, but she may be able to tell you which form to fill out and how to file it and such, and all to often "the magic phrase" to get things rolling for you. I have worked with Legal Aid of Northwest Texas before on my case. They do an intake session and determine your eligibility based on your income and case. It will help that you already have a temporary order.

They should be able to help you file a Motion of Enforcement for the child support and back support. If that's not the proper document they can advise you on the right one.

The AG office DOES go by temporary orders though. Call them again or go to the office in person and stay on them. They are not the fastest thing in the world, but if you keep on them, they do help you. I heard cases in the past where they even went into the father's saving/checking account and took money out. So it DOES work IF you're pushy and persistent. Good luck and I hope you get every penny that is owed to your son.

Sorry to hear about your situation. I have been there and can understand your pain. If you have temporary orders which normally that will be approved by the court before the "final" divorce then you could do something. Like call the constables office and they can have him picked up (jailed) due to non child support payments. Sorry to say until you have temp orders or final divorce decree I don't think there is anything you can do. Good Luck and many blessings to you.

I would believe that once child support is court ordered, which it sounds like it is. He is responsible for paying, and is going against a court order if he does not.
If you cannot afford an attorney, contact some of the local agencies that may help with legal fees. You might even contact the judge's office and just ask them about how you would go about handling this.
It really would be in your best interest if you could get a lawyer, if some one in your family can loan you some of the money, or perhaps a lawyer would agree to fees being paid when back child support is paid... or if you have a friend who might be a lawyer who can advise you.

I'm an attorney in Wise County. You need an Employer's Order to Withhold for Child Support if the court has already ordered that he pay temporary child support. I don't know why the Attorney General's office told you that they can't do anything until a final order is entered. They have been filing interventions in a lot of my divorce cases so I don't know why yours would be any different.
I would certainly suggest that you contact Legal Aid in your area to see if you qualify for services. If not, all of the forms you need are available at the law library. The librarians cannot give you legal advice but they might be able to point you in the right direction.

I think you can get what is called a temporary order of support.
