My ex stopped paying Child Support last June, stating that he was let go due to the economy. Ok...bummer deal right. Well the woman he had an affair with while we were married, and had a daughter with is still getting her support. (she found me on Facebook, and we got to talking) She has family in the goverment that works for Child Support, so she has a "IN". By the way he remarried another woman, and they have a daughter together as well. (we have son together)

I am working with another state (because we divorced in the state I lived in at the time) and they are taking forever to get anything done. Everything is communicated by Email, I can't speak to my case worker(she dont have a direct line), they were suppose to do a federal income tax return intercept, that I don't think they did.

Anyone else have this kind of issue? Does anyone have any advise on how to get better help?

If you are receiving ANY type of state aid for the kids or yourself, such as a medical card or food stamps then the state has the child support enforcement department for that reason. They seek to get child support for people to help them got to a point they don't need state assistance anymore. So,I think they help them first, next to that, I would talk to an attorney about finding out the truth about his finances. If he is still paying child support to another child someone should be splitting that money and giving half to you and half to the other mom.

If things are really hard for you and you have to apply for state aid services then the state will go after him with a vengeacnce. That's the only way that I know of to get around all of the red tape. My hubby's ex applied for medicaid and since my hubby had been paying his child support directly to her instead of through the state, the state came after him for tens of thousands of dollars in arrears. She tried telling the state that he'd been paying. She provided the records and everything and they still put a lien on our house until she went in to court and explained the whole thing to a judge... It was insanity! They also refused to reimburse him for the money they had started garnishing out of his paychecks toward the so-called "arrears" and they told him it was now considered a "gift". Get your state involved. If you ask them for help, they're going to bend over backward to make sure you are getting all other support you are entitled to first!

Please believe me when I tell you - contact your elected officials. It sounds corny, but you get instant results. I have had child support issues while waiting for the Attorney General to get it together. I was getting nowhere fast. I called my Congressman and his staff called someone at the AG and my stuff was resolved pronto. And they followed up with me to make sure everything had been resolved. I've contacted my reps on other issues too and they really do help.

It is totally not his call to "amend" his child support order according to his income (or lack thereof.) Report him to the state he lives in, report the situation to child services in the state you live in as well. Though the child support was ordered in the state you formerly lived in, you should have advocates in your current state of residence. As mentioned below, you can go to them for aid, so it's in their best interest to help you not need it. Best wishes to you!

Child support orders stand regardless of employment status unless you go back to court and get a new order. Typically, if any support is going to Child Support Enforcement, the oldest child is taken care of first. You need to contact CSE NOW and find out what is happening.
