Do I need an attorney to adopt my step-child? The bio-mom is willing to give up her rights .

ALWAYS get an attorney for these types of things.........that way, there are no loopholes if the Mom decides to change her mind or she is trying to be vendictive in some way...........you want it all legal and right.........

Congrats! My X's wife wouldn't give up the rights even tho the kids lived with us........she made their life miserable by coming in and out of their lives and there wasn't anything I could do about it....

Yes, you do. The process for adopting a step child is really the same as adopting a child through an agency. It is a legal process that will involve time and money- as well as interviews by someone appointed by the judge. Even if bio-mom is willing to sign over her legal rights, the court has a responsibility to your step-daughter to make sure you are a responsible parent.

Get an attorney who specializes in family law and make sure you get it done right the first time! My niece went through this process several years ago so that her husband could adopt her daughter. It seems like it would be quick, especially b/c he was the only father she ever really knew! I was quite surprised, but pleased that the time was taken to make sure that Ben was going to be an appropriate parent- we already knew he would be, but not everyone is as lucky!

not sure if legal aid would do it with all the papers i say call and have a consultation but to warn you i was priced about 2000 to try and adopt my stepson

We got a lawyer for our step-parent adoption. They have to handle all of the paperwork. It cost us about $1500.

I would.....just to make sure all the bases are covered. I have adopted 3 and you don't want any loopholes.

how long have you and your husband been married first? if its been less than a year than you will have to pay an extra $500 for an in home inspection that does not guarantee an adoption. but if youve been married for a year you still have the inspection but it doesnt cost $500, but also each state laws differs from others. my lawyer said with a willing parent it would still cost me around $2500 all together, and sometimes with a willing parent, you may have to pay for their legal finances in the matter. go to www.laborlawtalk.com they have a forum specifically about this. i hope the best for you!

Bio-mom probably needs an attorney.
See if your local court system has a mediation or arbitration service.
Make sure she's been advised about what she's agreeing to.
