I had a car accident back in February. And my car insurance wants to file a "friendly lawsuit" against me. They said that since my kids were in the car accident with me and had serious injuries that they have a 2 year period to file a lawsuit against me after they turn 18. Does anyone know anything about this or is this away for them to get the money out of me personally and not pay the bills according to my plan I had with them? If anyone knows about this or has a number I can call a lawyer and ask them it would be greatly appreciated.

So What Happened?

Thanks everyone for the advise. I spoke with a couple of lawyers that were referred to me. They said there is such a thing called a "friendly lawsuit". But there are things that have to be found out. Such as how much of the bills were paid through the health insurance, where would the money be going for the kids (trust fund or such),who will be responsible for the rest of the medical bills not covered (that just depends on how much your car insurance policy holds). It's very stressful. But just to let you know there is such a thing. Thanks again everyone.

I don't know if that can happen or not. How strange is that?
This is your insurance company, I mean didn't you pay them to protect you and not sue you? Well, I have heard silly things and this ranks in the top 5. I can't imagine they can even do that. If that was possible, don't you think that every one that had insurance would be sued after an accident if their kids were in the car. I can't even imagine a law that protects them and allows them to do that. Here, let me allow you to pay me monthly payments to cover you in case of accident, but if you have an accident I can sue you for it. That's crazy!
I am going to do some research on this for you, because I want to know the answer myself. I feel so bad for you.
A working mother of 3 children, and I am just so sure you have the time and available stress to deal with the likes of this.

Sorry to hear about your accident. My 2 sisters were in a very serious accident about 12 yrs ago. My older sis (who was 19 at the time) was driving and my younger sis (12 at the time) was in front. My younger sis was careflighted and in a coma for several days, broke bones in face and had blood clots in brain. They are both fine now. But my older sister's insurance told my parents that they should file a "friendly lawsuit" for my little sis against my big sis, so they did. It just gave her a settlement for when she turned 18. I believe it did nothing to my older sister. It was just a great thing for my little sis (gave her college money!!)

But that was 12 yrs ago, I am sure it would still be about the same. If it does not go bad against you, it could be a way for your children to have college/security money when they are 18.
